City Council Meeting – August 18, 2014

A general ordinance amending the Springfield Land Development Code, Article I, Zoning Ordinance, to add a new Subsection 6-1217, Maximum Bufferyard Area, to allow bufferyard reductions for small lots. (Both Planning and Zoning Commission and staff recommend approval.)

A general ordinance amending the Springfield Land Development Code, Section 1-1600, Zoning Maps, by rezoning approximately 18.61 acres of property generally located at 1530 East Erie Street from Planned Development District No. 323 to Planned Development District No. 323 Amended. (Both Planning and Zoning Commission and Staff recommend approval.)  By:  TLC Properties, 1530 E. Erie Street; PD 323 Amended.

A general ordinance amending the Springfield Land Development Code, Article I, Zoning Ordinance, Division I, Intent, Purpose, and General Provisions, and Division V, Supplemental District Regulations, to allow the use of utility poles for wireless telecommunications support structures.  (Both Planning and Zoning Commission and staff recommend approval.)  

A special ordinance authorizing the City Manager, or his designee, to enter into an Amended Memorandum of Understanding with the City of Springfield Board of Public Utilities for the purpose of shifting from in-kind compensation for the use of the City’s rights-of-way to payment per linear foot.

A resolution requesting those vacant positions within the City currently frozen due to City Council’s request be unfrozen at the City Manager’s discretion.

A special ordinance authorizing the City Manager, or his designee, to accept a grant from the Federal Emergency Management Agency (FEMA), Assistance to Firefighters Grant (AFG) program, for the purchase of self-contained breathing apparatus (SCBA), and amend the budget of the Fire Department, for Fiscal Year 2014-2015, in the amount of $639,486.

A special ordinance authorizing the issuance of Use Permit 413 to permit a professional office, art gallery, and art studio, as an adaptive use of a non-residential structure, at 1571 East Cherokee Street within an R-SF, Single-Family Residential District on certain conditions. (Planning and Zoning Commission and staff recommend approval.)

A general ordinance amending the Springfield Land Development Code, Section 1-1600, Zoning Maps, by rezoning approximately 1.30 acres of property, generally located at 211 East Water Street, from an HM, Heavy Manufacturing District to a CC, Center City District. (Planning and Zoning Commission and staff recommend approval.)  By:  Clan Macquarrie, LLC; Z-16-2014.

A special ordinance approving the transfer of a small parcel of real property located at 2157 North Boonville Avenue to Randy Alcorn and authorizing the issuance of a deed for same.

A special ordinance authorizing the City Manager, or his designee, to enter into an Agreement for Encroachment License with MBH, LLC, dba Vandivort Hotel, LLC, for the purpose of allowing an encroachment onto City rights-of-way for the placement of lighted bollards on property located at 305 E. Walnut Street, under the same terms and conditions as encroachments are permitted on City rights-of-way under Chapter 98, Article VII of the Springfield City Code.

A special Ordinance accepting the bid of Reed’s Plumbing & Heating, Inc., in the amount of $88,390.00 for the construction of sanitary sewers in Sanitary Sewer District No. 89 of Section No. 18, located in the vicinity of Linro Lane at Kearney Street; declaring the work to be necessary; stating the intention to pay for all or part of the improvements from the proceeds of bonds; specifying those costs and expenses to be assessed against the properties in the district and the method by which the costs will be apportioned; setting forth the manner of payment, the lien of the assessments, and the duration of the lien; setting forth the interest rate to be charged on the tax bills; authorizing the City Manager, or his designee, to enter into a contract and to approve the bond for said improvement; and authorizing progress payments to be made to the contractor.

A special ordinance authorizing the City Manager, or his designee, to accept a grant from the Missouri Commission on Human Rights (MCHR) Fair Housing Partnership Initiative Funding Program to be used by the Mayor’s Commission on Human Rights and Community Relations (MCHRCR) for furthering its fair housing initiatives; and amending the budget of the Department of Planning and Development for Fiscal Year 2014-2015 in the amount of $1,000 to appropriate the grant funds.
